1. Definitions
In these Terms of Service (the Terms):
- HoHoChiHeaven means the online service operated under the name HoHoChiHeaven and made available at hohochiheaven.co.uk (the Site).
- Operator means the person(s) or entity responsible for operating the Site and providing the services available through it, as identified on the Site where contact and company information are provided.
- User, you or your means any person who accesses or uses the Site, whether registered or unregistered.
- Content means any text, images, audio, video, graphics, logos, data, software or other material published on or made available through the Site, including User Content.
- User Content means any Content that a User submits, uploads, posts, transmits or otherwise makes available on or through the Site.
- Services means the features, functionality, information and any related services offered on or through the Site.
- UK GDPR means the United Kingdom General Data Protection Regulation as incorporated into UK law, and the Data Protection Act 2018.
2. Acceptance of these Terms
By accessing or using the Site, you confirm that you have read, understood and agree to be legally bound by these Terms. If you do not agree, you must not use the Site.
If you use the Site on behalf of a company or other organisation, you represent and warrant that you have authority to bind that organisation to these Terms, and in that case “you” and “your” refer to that organisation.
Consumers: Nothing in these Terms affects your statutory rights.
3. About the Site and Contact
The Site is operated under the name HoHoChiHeaven. Information enabling you to contact the Operator (including a contact method and, where applicable, company details) is provided on the Site where contact and legal information are displayed. The Operator may communicate with you by posting notices on the Site or by using the contact details you provide.
4. Eligibility and Age
The Site is intended for persons aged 18 or over. If you are under 18, you may only use the Site with the involvement of a parent or legal guardian. Where we rely on consent to process personal data for information society services, you confirm that you are at least 13 years old or that verifiable consent has been provided by a holder of parental responsibility.
5. Access and Use of the Site
You agree to use the Site lawfully and in accordance with these Terms. In particular, you must not:
- use the Site in any way that breaches any applicable law or regulation or infringes any third-party rights;
- upload, post or transmit any Content that is unlawful, harmful, defamatory, obscene, discriminatory, infringing, invasive of privacy or otherwise objectionable;
- impersonate any person or misrepresent your identity or affiliation;
- attempt to gain unauthorised access to the Site, accounts, data or systems, or introduce viruses, malware or other harmful code;
- copy, scrape, crawl, harvest or extract data from the Site other than as permitted by applicable law and normal browser usage;
- reverse engineer, decompile or disassemble any part of the Site except to the extent permitted by law;
- interfere with, damage or disrupt any part of the Site or any equipment or network on which the Site is stored.
The Operator may suspend, restrict or terminate access to the Site at any time for maintenance, updates, security, business needs or breach of these Terms.
6. Accounts, Security and Communications
If the Site allows or requires you to create an account, you must provide accurate, current information and keep your login credentials confidential. You are responsible for all activity under your account. Notify the Operator promptly if you suspect unauthorised use or any security breach.
The Operator may send you service, transactional and legal notices. Where you opt in, the Operator may also send you marketing communications, which you can opt out of at any time.
7. User Content
- Your responsibility: You are solely responsible for your User Content and for ensuring that you have all rights necessary to submit it and grant the rights described below.
- Prohibited content: You must not submit User Content that violates section 5 or any applicable law or third-party rights.
- Licence you grant: By submitting User Content, you grant the Operator a worldwide, non-exclusive, royalty-free licence to host, store, use, reproduce, modify, adapt, translate, publish, publicly display, publicly perform and distribute that User Content for the purpose of operating, improving and promoting the Site and the Services. You also grant other Users a non-exclusive licence to access your User Content through the Site and to use it in accordance with these Terms and the functionality of the Site.
- Moderation: The Operator may, but is not obliged to, monitor, remove or edit User Content at its discretion, including where it breaches these Terms or the law.
- Moral rights: To the extent permitted by law, you waive and agree not to assert any moral rights you may have in your User Content against the Operator and its licensees.
8. Intellectual Property
Except for User Content, all Content on the Site and the Site’s selection and arrangement are owned by the Operator or its licensors and are protected by copyright, trade mark and other intellectual property laws. “HoHoChiHeaven” and any related names, logos and marks are trade marks of the Operator or its licensors.
You may view the Site and print or download extracts for your personal, non-commercial use only, provided you do not remove any proprietary notices. Any other use of the Site or Content, including reproduction, distribution, modification or creation of derivative works, is prohibited without prior written permission from the Operator or the relevant rights holder.
9. Third-Party Services and Links
The Site may contain links to third-party websites or integrate third-party services. Such links and integrations are provided for convenience only. The Operator does not endorse and is not responsible or liable for third-party content, products, services, privacy practices or terms. Your use of third-party sites and services is at your own risk and subject to their terms and policies.
10. Personal Data and Privacy
The Operator is the controller of personal data processed in connection with the Site. The Operator processes personal data in accordance with UK GDPR and the Data Protection Act 2018.
Data collected: Depending on your interactions with the Site, the Operator may collect and process:
- Identifiers and contact details (such as name, username, email address, phone number);
- Technical and usage data (such as IP address, device and browser type, access times, pages viewed, interactions and diagnostics);
- Transaction data (such as orders, bookings or payments, if offered on the Site);
- Communications and User Content you submit; and
- Preferences and consent records.
Purposes and lawful bases: Personal data may be used for: providing and operating the Site and Services (performance of a contract or legitimate interests), account administration and security (legitimate interests, legal obligations), responding to enquiries (legitimate interests), sending service notices and, where you consent, marketing communications (consent), processing transactions and preventing fraud (performance of a contract, legitimate interests, legal obligations), and complying with legal obligations.

The Site and Content are provided for general information and entertainment purposes only and are not professional advice. Although the Operator aims to keep information accurate and up to date, the Operator does not warrant that the Site or Content will be complete, accurate, reliable, available, secure or error-free.
The Operator may update, modify, suspend or discontinue any part of the Site or Services at any time without notice.
13. Disclaimers
To the fullest extent permitted by law and subject to section 14, the Site and all Content and Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose and non-infringement. Where you are a consumer, the Operator will provide services with reasonable care and skill and nothing in these Terms limits rights and remedies available to you under consumer law.
14. Limitation of Liability
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.
Subject to the paragraph above and to your statutory rights as a consumer, the Operator will not be liable for:
- losses that were not reasonably foreseeable to both you and the Operator when you agreed to these Terms;
- losses not caused by any breach by the Operator; or
- loss of profits, loss of business, business interruption, loss of anticipated savings, loss of goodwill or loss of data, in each case whether direct or indirect, where you use the Site for non-consumer purposes.
Subject to the first paragraph of this section, and where permitted by law, the Operator’s total aggregate liability to you arising out of or in connection with the Site, the Services and these Terms (whether in contract, tort, negligence or otherwise) shall not exceed the greater of £100 or the total fees (if any) paid by you to the Operator for chargeable Services during the twelve months immediately preceding the event giving rise to the liability.
15. Indemnity (Business Users)
If you use the Site for business purposes, you agree to indemnify and hold harmless the Operator from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or in any way connected with your breach of these Terms, your User Content, or your misuse of the Site. This indemnity does not apply to consumers using the Site for domestic and private use.
16. Suspension and Termination
The Operator may suspend or terminate your access to the Site or any account immediately if you breach these Terms, if the Operator is required to do so by law, or for security or operational reasons. You may stop using the Site at any time and, where applicable, request closure of your account. On termination, sections that by their nature should survive will continue to apply (including sections 7 to 17).
17. Changes to these Terms
The Operator may update these Terms from time to time, for example to reflect changes in the Site, Services, legal requirements or business practices. When changes are made, the Operator will post the updated Terms on the Site with a new effective date. Changes take effect when posted. Your continued use of the Site after the effective date constitutes your acceptance of the updated Terms.
18. Applicable Law and Jurisdiction
These Terms, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or their subject matter or formation, are governed by the laws of England and Wales.
The courts of England and Wales will have exclusive jurisdiction to settle any such dispute or claim. If you are a consumer resident in Scotland or Northern Ireland, you may bring proceedings in your local courts.
19. Miscellaneous
- Severability: If any provision of these Terms is found to be invalid or unenforceable, the remainder will continue in full force and effect.
- No waiver: A failure or delay by the Operator to enforce any right or provision under these Terms shall not constitute a waiver of that or any other right or provision.
- Entire agreement: These Terms constitute the entire agreement between you and the Operator regarding the use of the Site and supersede any prior agreements or understandings relating to the Site.
- Assignment: The Operator may assign or transfer its rights and obligations under these Terms to another organisation. You may not assign or transfer your rights or obligations without the Operator’s prior written consent.
- Third-party rights: Except as expressly stated, no person other than you and the Operator has any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these Terms.
